Supreme Court is hearing a plea by Centre for PIL challenging the appointment of Rakesh Asthana [LIVEUPDATES]

appointment of Rakesh Asthana IPS as the Commissioner of Police.

Justice Chandrachud: SG Mehta appears on behalf of the Union of India. SG has raised a preliminary objection regarding maintainability of plea under article 32 since after SC order of Aug 25, 2021, the Delhi HC was requested to a hear a plea on similar issue

DYC J: The judgment of the Delhi HC has been rendered on October 12. In this view, SG Mehta has submitted since Mr Bhushan had also intervened it would be necessary to challenge the HC judgment under article 136. Bhushan informs a SLP will be filed by Monday

DYC J: In this scenario we direct the SLP to be listed on next Wednesday.  A copy of the petition be served upon the lawyer instructing SG Mehta

SG: Mr. Bhushan is always trying to run the govt let him not run the courts.

Sr Adv Mukul Rohatgi requests for a later date

Matter now posted to next Friday

Rohatgi: this writ is now infructuous since a SLP will be filed now

SC: We will see about that

Bhushan: We have served them a copy

SG: We only have a copy which they had given to the press.
