SC registry turns down plea by Kejriwal to list application on extension of interim bail

NEW DELHI: The Supreme Court registry has turned down a plea filed by Delhi Chief Minister, Arvind Kejriwal, to enlist his application seeking extension of his interim bail for 7 days beyond June 1, for undergoing medical tests.

The SC registry termed the application as not maintainable since the court had earlier allowed him to approach the trial court for the regular bail. It also noted the instant plea had no connection with the matter questioning validity of arrest in which the judgment was reserved on May 17.

On Tuesday, a bench of Justices J K Maheshwari and K V Viswanathan told Abhishek Manu Singhvi, appearing for Kejriwal, the mention memo would be referred to the Chief Justice of India for fixing a date of hearing.

The court had asked the counsel why the CM's application was not mentioned before a bench headed by Justice Dipankar Datta last week.

Singhvi had sought urgent hearing on Wednesday in the plea, saying that the Delhi CM needed urgent medical check up to find out about his health conditions.

The court said since the bench of Justices Sanjiv Khanna and Justice Dipankar Datta, which granted interim bail till June 1 to Kejriwal, have reserved the verdict on his main plea on May 17, it would be appropriate to place his plea for extension of bail application before the CJI for appropriate orders on listing of the application.

"The CJI will take appropriate decision on listing of CM Kejriwal's plea for extension of interim bail as verdict is reserved in the main case," the bench said.

Kejriwal has filed a plea in the Supreme Court for an extension of his interim bail by seven days beyond June 1, as he has to undergo PET-CT scan and other tests.

A bench of Justices Sanjiv Khanna and Dipankar Datta had on May 10 granted him interim bail till June 01 to participate in election campaigns, and directed him to surrender on June 02 in the liquor policy scam case.

Kejriwal, in his plea, claimed that after his arrest he had lost seven kilogram weight. His Ketone level is very high. This could be a symptom of a serious disease. "The doctors of Max hospital, treating him at present, have advised some tests," he said in his plea.

Kejriwal sought seven days to complete all these tests done in these time.

Kejriwal, the national convenor of Aam Aadmi Party, was arrested on March 21, 2024 in the liquor policy scam case. The Enforcement Directorate had called him kingpin and main conspirator and received Rs 100 Cr for Goa polls campaign.

He has challenged validity of his arrest by the Enforcement Directorate.

He was granted interim bail, though he has not filed any bail plea.

The Supreme Court had on May 17 reserved its judgement on his appeal challenging his arrest by the Enforcement Directorate and subsequent remand in the 2022 Delhi liquor policy scam case.
