SC stays any amendment in Delhi Master Plan 2021

By LawStreet News Network      06 March, 2018 02:15 AM      0 Comments

The Supreme Court today has stayed any move by Delhi Development Authority to amend Delhi Master Plan 2021 aimed to grant relief to commercial establishments from sealing.

The Bench headed by Justice Madan B Lokur taking up the matter for hearing in the case of MC Mehta v. Union of India, pertaining to sealing drive has passed the order after Advocate Ranjit Kumar who is an amicus in the matter, brought to the courts attention that DDA had not filed the affidavit as per the courts order on February 9.

As per the February 9 order, the DDA, the Municipal Corporations in Delhi and the Delhi Government were to file an affidavit explaining if various assessments like environment impact, traffic, congestion and other safety aspects were made before going ahead with the amendment.

Displeased with DDA justice Lokur said that why will they file? They want people to die..see you are taking the Supreme Court of this country for a ride..the attitude is like we will do whatever we want you may say anything. This is nothing short of contempt; this dadagiri has to stop.

Master Plan 2021 is a blueprint for urban planning and expansion in the metropolis to ensure overall development.

The proposed amendments were for bringing a uniform floor area ratio (FAR) for shop-cum-residential plots and complexes at par with residential plots.

FAR is the ratio of a building's total floor area (gross floor area) to the size of the piece of land on which it is built.
