New Delhi: The Delhi High Court has issued notice in a high-profile inheritance dispute concerning the estate of late industrialist Sunjay Kapur, as litigation intensifies between his widow, Priya Kapur, and his mother, Rani Kapur, over the validity of a family trust and control of substantial assets.
The matter came up before Justice Mini Pushkarna, who issued notice on an application filed by Priya Kapur seeking dismissal of the civil suit instituted by Rani Kapur. Priya Kapur has contended that the suit, which challenges the validity of the Rani Kapur Family Trust (RK Family Trust), is an abuse of the process of law and is based on unfounded allegations of fraud.
Rani Kapur, aged 80, has sought a declaration that the trust is illegal, void, and the product of fraud, forgery, and undue influence. In her suit, she has claimed that assets forming part of the estate of her late husband, Surinder Kapur, were transferred into the trust without her knowledge or consent. She has further sought dissolution of the trust, restitution of assets, and rendition of accounts.
Priya Kapur, on the other hand, has disputed these allegations and questioned the maintainability of the suit. The High Court has granted time to Rani Kapur to file her response to the dismissal plea, with liberty to Priya Kapur to file a rejoinder thereafter.
The dispute assumes significance given that the trust is understood to hold substantial shareholding in major corporate entities associated with the Kapur family’s business interests. The litigation also intersects with claims raised by Sunjay Kapur’s children from his earlier marriage, who are reportedly contesting aspects of succession and testamentary arrangements.
In related proceedings, pleas have also been moved seeking interim protection against alleged siphoning or dissipation of trust assets during the pendency of the case. The Court has indicated that questions surrounding management and control of the trust will be examined in accordance with law.
During the hearing, the Court is reported to have encouraged the parties to consider mediation in view of the familial nature of the dispute and the sensitive issues involved. The matter is now listed for further hearing in March 2026.
The case raises significant questions relating to the law of private trusts, succession, fiduciary obligations, and the standards required to invalidate a trust on grounds of fraud or undue influence.
