Supreme Court All India Judges Association pension to retired judges

Supreme Court to hear a plea filed by All India Judges Association for payment of pension to retired judges on par with in-service judges.

Bench: One of the IAs will be listed after vacation.

Amicus: I have filed a chart in another IA given the particulars of states which have complied with the order dated 05.04.2022 and those states which have not complied.

Order: The states which have not complied with the order of the court dated 05.04.2022 must comply with it and then, report to be sent to the amicus.

Adv: Another IA is there which is filed by Calcutta High Court for holistic construction of infrastructure for the subordinate judges. This will impact the situation all across India.

Bench: Please place it before the 3 judges' bench.

Amicus: In 2010 your lordships have approved that the retired district judge shall get benefits such as of the district judge in service. This includes medical bills etc.

Adv: Give me some time in this milords, i will file another IA.

Amicus: I will also file one IA with respect to this.

Order: The High Court allowed the writ petition and directed the state government to implement the recommendation of the Shri Padmanabhan Committee and to extend the medical facilities of reimbursement which was applicable to the serving officers to the respondent (retd judge).

 



Order: the State of Maharashtra has filed the SLP challenging the said order of the High Court. Justice Padmanabhan Committee report dealt with medical benefit to retired judges. This court by an order dated 26.07.2010 approved the recommendation of the Committee.

Order: Resultantly, this court also observes that there is no objection by any state to accept the recommendation of the committee. In view of the order passed by this court, the respondent is entitled for medical facilities recommended for serving judicial officers.

Order: there is no justifiable reason for the state of Maharashtra to deny the medical benefit to the respondent. Therefore, the High court is justified in granting the relief. State of Maharashtra has the liberty to amend the rules. All other states also must extend the benefit.

Bench: We and all judicial officers appreciate your efforts Mr Amicus.

Rao J: I am thanking you personally because I won't be there on the next date of hearing.
