Supreme Court Disha Encounter case

Supreme Court is hearing a case relating to inquiry into Disha Encounter case.

Bench- Committee has given a report.

Sr Adv Shyam Divan submits that report submitted be kept sealed.

CJI: Theres nothing to keep, the
Commission has found someone guilty we want to send the matter to the HC.

Divan- you may place this matter before the high court, please keep the report sealed

CJI: Its a public inquiry which is conducted!

Divan- We dont know the finding.

CJI- well read the finding.

Divan- You had allowed SIT to proceed which had submitted its own report

CJI- We have to send back to HC as we cant monitor this case. A detailed report  is submitted. Question is whats the proper action to be taken. They have made recommendations. Let matter go to HC.

Mr Divan submits that considering the gravity of offence and in interest of justice the report be kept sealed.

CJI: When SC appoints a committee it submits a report. Whats course open to court? Please tell.

Divan- Your Lordships have done it in the past.

CJI: If theres a matter regarding grave security etc well consider, this is an encounter case. The committee was appointed and has submitted a report.

CJI: Theres no question of our further examining the matter, let the HC hear the matter.  Ultimately some end has to be there, without looking at the report, you cant make submissions right?

Bench- We are on issue of report, please consult your clients and well come back
