Supreme Court Legal dispute Delhi Government Central Government

Supreme Court is hearing the matter regarding the legal dispute between the Delhi Government and the Central Government regarding control over administrative services in the national capital.

Bench: There are 2 issues. 2 items. 1 is difference of opinion of 2 judges & 2nd thing is the petition filed by your govt with regards to the validity of the New Act.

Singhvi: Reasons are simple required to be heard urgently. If i NCT which is democratic representative form of government, If  i have to appoint secretary  in Department X, I cant do it in entry 41

Singhvi: Justice Sikri said, above the Joint Secretary you consult and below you dont consult. It is having very deleterious effect.

Sr Adv AM Singhvi: Im a Government but I cant transfer Officers. If i am gvt, and can't appoint & govern officers, and if they know, the discipline will be 0. This first matter is extremely urgent.

Item 102 is fresh matter, it challenges act of 2021.

ASG Jain: the matter needs to be referred to Constitution Bench. Whichever day you decide please give me 30 minutes

CJI: We dont think its required. I think three of us can resolve the case. If you can show us there have to be more then okay. We are admitting and issuing notice.

ASG: the Petition is already pending before Delhi HC

Bench: 3 Judge Bench will hear the matter. Were issuing notice. List after 4 weeks.
