New Delhi: The Supreme Court has scheduled a hearing on the plea of former Jharkhand Chief Minister Madhu Koda, who seeks a stay on his conviction in a coal scam case. Koda is requesting the stay in order to contest the upcoming assembly elections in the state.
A bench comprising Justices Sanjiv Khanna, Sanjay Kumar, and R. Mahadevan is hearing the case. During today’s (24 Oct 2024) proceedings, Justice Khanna noted that the file had only been circulated in the morning and deferred the matter until tomorrow.
Senior Advocate R.S. Cheema, appearing for the Central Bureau of Investigation (CBI), was questioned by Justice Khanna regarding a previous Supreme Court judgment on the suspension of conviction. Justice Khanna pointed out that the threshold for suspending a conviction is different from the threshold for granting bail, asking Cheema whether he was aware of this distinction. Cheema responded that he was not aware of the judgment in question.
Justice Khanna further commented that he had only a few minutes to go through the file but recollected that the issue of suspension of conviction had been raised in some prior judgment.
The matter is now re-listed for hearing tomorrow.
