SC to hear plea seekingdirection to quash and stay notices sent by UP Govt to recover damages on account ofCAA protests

Supreme Court to hear plea seeking direction to quash and stay notices sent by Uttar Pradesh Government to recover damages for the public loss caused to public property by alleged protestors on account of protests against the Citizenship Amendment Act, 2019 [CAA].

UP AAG: We have honoured the courts observations. All showcause notices have been withdrawn. District magistrates were also informed. All 275 files were also sent to the claims tribunal

Justice Surya Kant: We appreciate the stand

UP AAG: Please grant liberty to issue the process under the new act. State also says that the intent of the judgment of the top court has been fulfilled. Ever since the act came into force no violent incidents or public property damage took place

SC: the idea of our judgment was that there should be accountability when public property is damaged. But a judicial mind has to oversee it and there is application of judicial mind

Adv Nilofer Khan: Please note that the new notices can be challenged in court of law or challenge the constitutionality of the legislation.

SC: That is not the subject matter before us.

UP govt tells SC that it has withdrawn notices issued to 274 anti-CAA protesters for recovery of damages done to  public property allegedly by them and also proceedings against them have been withdrawn.

Supreme Court hears an appeal against Karnataka HC order which had allowed the filing of closure report in sexual assault case filed against BJP MLA and former minister Ramesh Jarkiholi

SC: Let the High Court decide the matter. We are informed SIT report has been submitted. Let HC decide. We request the HC on March 9, 2022.

Plea disposed off.

No adjournments to be granted.
