Suspension of a public-school teacher who was allegedly removed for demanding payment of salaries stayed by Delhi HC

The suspension of a public-school teacher who was suspended from the position of TGT English allegedly for demanding salaries to teachers and other staff was stayed by the Delhi High Court.

A Single Bench of Justice Jyoti Singh also issued notices to Ravindra Public School and the Directorate of Education.

The order comes after a petition was filed by a public-school teacher challenging his suspension from the post of TGT English for allegedly demanding salary payment to the school staff.

The petitioner claimed that he had been removed for raising concerns about the teachers and staff of the school. He also said that as the President of the Teachers Association he had been demanding the school management regarding salaries and other benefits to the teachers and other staff, from March 2020.

Another writ petition was filed before this Court by some staff members of the School, including the petitioner, seeking the benefits of 6th and 7th pay Commissions under Section 10 of the Delhi School Education Act, 1973.

The petitioner submits that since he was leading the staff and voicing their demands, he has been illegally suspended by a Suspension Order dated 17/06/2020, for 4 weeks till 16/07/2020.

The petitioner argued that the Suspension Order was mala-fide and also against Section 8(4) of the Delhi Education Act, 1973 read with Rule 115 of the Delhi School Education Rules, 1973 where it is stated that a private unaided school cannot suspend an employee without prior approval of the Directorate of Education. 

The matter will be next heard on 7th September.
