Uttarakhand HC orders online tuition course for juvenile in children’s home as an example of Right to Education [READ ORDER]

Elucidating the importance of Right to Education, the Uttarakhand HC has directed the SI of children’s home in Haridwar to arrange for online tutorials for the juveniles who are willing to enroll for graduation.


The bench consisted of Chief Justice Raghvendra Singh Chauhan and Alok Kumar Verma.

This decision followed after the bench heard a revision petition filed by a juvenile convicted under S.376-D, 120B,34 of the IPC and Section 5/6 of the POCSO Act for the offence of gang rape.

The applicant is serving his sentence at children’s home in Haridwar. He moved to interlocutory application, expressing his interest to pursue his education from Lovely Professional University, Punjab.

His Counsel, Adv. Aditya Singh, submitted that his examinations commence from the 28th of June and therefore the State should make arrangements for him to appear.

The court observed that under Article 21, the plea is valid and hence all arrangements to be made shall be directed.

It its further notified to the Superintendent (SI) of the Children’s home to ensure that the revisionist is allowed to complete the aforementioned.
