'Very irritating', SC chides Bilkis counsel for everyday mentioning of plea against remission


NEW DELHI: The Supreme Court on Wednesday chided a counsel for Bilkis Bano for mentioning for listing "everyday" her writ petition against remission granted to 11 convicts in a case of gang rape and murder of her family members during the 2002 Gujarat riots.

"Writ petition will listed. Don't keep mentioning the same thing again and again. It is very irritating," a bench led by Chief Justice D Y Chandrachud told the counsel.

Advocate Shobha Gupta, appearing for Bilkis, submitted that the writ petition was listed on Tuesday but it was not taken up.

"So! Don't keep mentioning. It will be listed. Review was also circulated yesterday," the bench said.

On Tuesday, Justice Bela M Trivedi, sitting in a bench led by Justice Ajay Rastogi, had recused to consider a writ petition by Bilkis in the matter. The matter as a consequence would be posted before another bench.

Bilkis had also filed a review petition against May 13, 2022 order by the Supreme Court which allowed the Gujarat government to consider remission ples by one of the convicts in terms of 1992 policy.

Subsequently, on August 10, the state government had decided to release all the 11 convicts, undergoing life term, on remission. A batch of petitions were filed thereafter challenging the state government's decision.
