In India the absence of a legal framework for data protection was a major concern for many years. Due to pressing demands and the Supreme Court’s landmark judgment in Justice K.S Puttaswamy v. Union of India, in which the court held that right to privacy is a fundamental right, a draft legislation on data protection was submitted by a committee of experts.
Headed by former Supreme Court judge B.N. Srikrishna, the committee of experts submitted a 176-page report, titled “A Free and Fair Digital Economy: Protecting Privacy, Empowering Indians”, and a 62-page draft Bill, titled The Personal Data Protection Bill, 2018. The draft Bill will become law after public comments are noted and Parliament clears it.
