Prayagraj: The Allahabad High Court has observed that court proceedings cannot be allowed to be stalled merely because a section of advocates does not want the Court to function, while the majority wish to argue their cases. The Court also cautioned young advocates about social media posts on the functioning of the High Court and asked the newly elected body of the High Court Bar Association to take appropriate steps to maintain the dignity of the High Court.
A Bench of Justice Arun Kumar Singh Deshwal made the observations on 30 October 2026 while dealing with a bail application filed by one Rajesh against the State of U.P. The Court recorded that no one appeared for the applicant to press the application, even after the list of fresh cases was revised, although the matter had been mentioned for being taken up out of turn.
The Court noted that counsel for the applicant could not appear because certain advocates forcibly stopped advocates who wanted to argue their cases, and that even the Additional Government Advocates were forcibly taken out of the Court. It further recorded that, during the hearing, it heard the cries of a lady advocate who wanted to enter the courtroom to attend her case but was misbehaved with and forcibly stopped from entering. According to the Court, such conduct on the part of some advocates is not conducive to the reputation and dignity of the Bar as well as the Court.
The Court took judicial notice of social media posts uploaded by certain young advocates about the functioning of the High Court and advocates. It said that such posts were made without thoughtful consideration that incomplete and twisted information may lead to unnecessary accentuation of differences between the Bar and the Bench. It advised young advocates to concentrate on their studies and on preparing their cases to build their careers, instead of focusing on increasing their social media likes, and added that “Young advocates are the future of the High Court.”
The Court observed that most of the Judges as well as senior advocates are trying their best to create a good atmosphere for the future of young lawyers, who will in time become senior advocates and Judges of the High Court.
Underlining the duty of advocates, the Court held that advocates command respect in society only because the public has trust in the High Court. It said that maintaining the dignity of advocates requires them also to work towards maintaining the dignity of the High Court, and that this is the duty of advocates as much as of Judges. The Court warned that if public trust in the High Court is eroded, mafias and certain unruly public officials will start harassing advocates, as, it said, recently happened in certain districts and was highlighted in several newspapers.
The Court also stated that government advocates are also advocates, and that the dignity of advocates includes the dignity of private advocates as well as government advocates.
Concluding, the Court expressed its expectation that the newly elected body of the Bar Association, High Court, Allahabad, would consider the issue and take appropriate steps to maintain the dignity of the High Court at a high pedestal. In the interest of justice, the bail application was adjourned for the day and has been listed on 26 November 2026.
