Mumbai: The Bombay High Court has recently declined to grant any interim relief to the petitioners challenging the 1-year ban on pan masala.
In an order passed on July 8, 2024, a Division Bench comprising Justices B.P. Colabawalla and Arif S. Doctor admitted the writ petition filed by Dharampal Satyapal Ltd & Anr. against the Food Safety Commissioner, Food and Drug Administration, Maharashtra & Anr.
Further, while refusing to grant any interim relief to the petitioners, the court noted that the petition raised arguable questions and therefore admitted it.
Additionally, the court observed, As far as interim relief is concerned, we are not inclined to grant any interim relief in light of the orders passed in other writ petitions in relation to a similar case already pending in this court, which also challenged the complete ban of 1 year on pan masala.
The petition challenges the prohibition order imposing a complete ban of one year on pan masala. The court, after considering the facts of the case and the impugned prohibition order, decided not to grant any interim relief.
Mr. Sanjai Pathak, along with Aashish Kaushik and Yash Wardhan Tiwari, appeared for the petitioners, while Mr. Kedar B. Dighe, Additional Government Pleader, represented the state respondents. Mr. Anjani Kumar Singh appeared for the Union of India.
