Kolkata: A Calcutta High Court judge has released a reserved bail matter from her list after recording that one of the petitioner's counsel, along with her private secretary, had attempted to access the case record from her chamber in what she described as a deliberate attempt “in collusion and connivance” with each other.
The order was passed by Justice Suvra Ghosh on 19th August 2026 in C.R.M. (R) 58 of 2026, an application filed by Sujit Bose seeking bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in a matter involving the Enforcement Directorate.
The Court recorded that the matter had been reserved for delivery of judgment on 17th August 2026. On 18th August 2026, while the Judge was in the courtroom, one of the learned counsel for the petitioner, along with the Judge's private secretary, went to her chamber and asked her staff present outside to bring out the record of the matter, which the staff refused. It was further recorded that they tried to enter the chamber and insisted on seeing the record, which was again resisted by the staff.
“Such conduct of the learned counsel and the private secretary is seriously deprecated, moreso, since it smells of an oblique motive on their part,” the Court observed, holding that in view of this deliberate attempt, it found it appropriate to release the matter.
The Court directed that the matter be placed before the Acting Chief Justice of the Calcutta High Court for appropriate directions.
