Mizoram Govt informs Gauhati High Court about the constitution of Mizoram State Human Rights Commission

Gauhati: The Mizoram government, on Wednesday (November 27), informed the Gauhati High Court at Aizawl that it has constituted the State Human Rights Commission under the provisions of Sections 21(4) and 21(1) of the Protection of Human Rights Act, 1993, with its headquarters at Aizawl.

The division bench, comprising Justice Nelson Sailo and Justice Marli Vankung, was further informed by the State Government that a notification regarding the creation of sixteen posts—including the Chairperson, two Members, Officers, and Staff for the new establishment—has been issued.

The learned Government Advocate, Ms. H. Lalmalsawmi, submitted that the respondents are in the process of considering the appointment of suitable persons as the Chairperson and Members of the Commission, in addition to identifying an appropriate building to house the new establishment.

Gauhati HC Seeks Update on Appointments and Establishment Progress

The petitioner’s counsel, Ms. Rosalynn L. Hmar, also informed the court that a proposal has been submitted to the State Government for the appointment of the Chairperson and the other two Members of the Commission for their consideration.

The court noted that some positive steps have been taken by the State respondents to establish the Human Rights Commission in Mizoram. However, the court emphasized the necessity of further steps to fully operationalize the Commission, including appointing suitable persons as its Chairperson and Members and filling the created posts.

As a result, the court adjourned the matter for eight weeks, directing the respondents to file an additional affidavit detailing the steps taken for establishing the Commission pursuant to the notifications dated October 11, 2024.

The case involves the Zofa Welfare Organization (ZWO) Mizoram, represented by Rev. Robawia, as the petitioner, against the State of Mizoram and five other respondents.
