Plea in High Court Against Delhi Government’s Decision to Seal Borders

A lawyer has approached the Delhi High Court challenging AAP-led government’s decision to seal the borders for 1 week amid the ongoing coronavirus induced lockdown.

The plea was filed by advocate Kushagra Kumar on the grounds that “It is an illogical, irrational, unreasonable and unconstitutional order and violative of Article 14, 19 and 21 of the Constitution of India.” 

It is likely to be heard on 4th June.

Kumar, in his petition, said, Delhi being the national capital of India, has centrally funded hospitals like AIIMS and by sealing the borders, the government is taking away the rights of those who work in Delhi and stay in NCR of availing such health facilities. It also said that the decision leads the citizens of other states like Uttar Pradesh and Haryana to be denied their basic right to access the central hospital in Delhi.

“In India, we do not have dual citizenship. Everyone is a citizen of this country and has the right to reside in any place and avail medical facilities in any place/s which he/she can afford,” the plea said.

It also said, “instead of creating medical infrastructure and ensuring medical facilities, it is sealing the borders and stopping people from availing medical facilities in Central hospital in Delhi.”

The order of the Delhi government is inhuman and illegal, according to the appeal.

It further stated, “By sealing the border, those working in Delhi & staying in NCR like Noida & Gurugram & those staying in different states like Uttar Pradesh, Haryana, etc, cannot avail the health facilities provided by the Central government in Delhi.”
