Prayagraj: The Allahabad High Court has held that no private CCTV camera can be installed and positioned in such a manner as to interfere with the privacy of a neighbour, and has directed a petitioner who complained about such a camera to approach the District Magistrate, who must decide the matter within one month.
A Division Bench of Justice Ajit Kumar and Justice Garima Prashad passed the order on 26 October 2026 in Writ-C No. 42270 of 2026.
The petitioner, Yogendra Maurya, approached the Court against the State of U.P. and seven others, aggrieved by the positioning of a CCTV camera by his neighbour. According to him, the camera exposes the entry to and exit from his house and interferes with the privacy of persons visiting his house or leaving it. It was contended that this amounts to a violation of privacy.
After hearing counsel for the petitioner and the Standing Counsel for the State, the Bench expressed its considered view that a private CCTV camera cannot be installed and positioned in a way that interferes with a neighbour’s privacy.
In the circumstances, the Court disposed of the petition with a direction to the petitioner to file an application before the District Magistrate concerned. It directed that, in the event the petitioner files such an application, the District Magistrate shall consider and decide it within a period of one month.
