Plea Seeking SOPs for Restaurants and Hotels in Light of COVID19, Delhi HC Asks Petitioner to First Move the Appropriate Authority [READ ORDER]

A petition has been filed through the Petition organization represented by Mr. Saurav Chadha and Ms. Jyoti Srivastav seeking the court to make Standard Operating Procedures (SOPs) for hotels and restaurants in Delhi. Moved by the Indian Law Watch, the petitioner sought directions to be issued to the Delhi government which is the present authority, and the Delhi Disaster Management Authority to provide the SOPs to hotels and restaurants in the current covid-19 pandemic situation.

A division bench of Justice Hima Kohli and Justice Subramonium Prasad has directed the appropriate authority i.e. the Delhi government to respond to the filed petition within three-weeks of time. The Court also noted the government to consider the suggestions made in the petition. The court noticed that the petitioner has directly approached the court without suggesting in relation to the current Respondents. The court also stated that if the plea of the petitioner sustains ahead, it shall be entitled to seek legal resources. Allowing the petitioner to withdraw the petition, the court noted that: -

'In view of the submission made hereinabove, the present petition is disposed of with liberty granted to the petitioner to make a substantive representation to the respondents No.1 to 3 within one week from today. The said representation shall be considered by the respondents No.1 to 3 and the same shall be replied to within three weeks from the date of receipt. The suggestions made by the petitioner in the representation shall be carefully considered by the respondents No.1 to 3 before responding.'
