High Court Of Uttarakhand Directs Centre And State To Seek Replies About Virtual Post-Mortem

On 15th September 2021, the High Court of Uttarakhand passed an order demanding rely from the Central and State Government in response to a Public Interest Litigation (PIL) filed regarding performing post-mortem in a virtual manner. 

 PUBLIC INTEREST LITIGATION 

The Public Interest Litigation was filed against the present manner in which post-mortem of bodies are conducted, as per the PIL, these methods are inhuman and wrong. 

During the Covid pandemic, the post-mortem of bodies was conducted virtually with the help of Magnetic Resonance Imaging (MRI) and CT scan which can continue even after the pandemic. 

This practice would not only make it easier to conduct post-mortems virtually with the help of the resources but also is efficient in the manner that it saves time and money. 

The petition also held that in order to convey the same matter to the Central Government the petitioner had provided them with a representation, however, they did not receive any reply which would satisfactorily answer their appeal. 

DECISION OF THE JUDGES

After both the parties were heard the Division Bench of the High Court consisting of Justice Sharad Kumar Sharma & Justice Alok Kumar Verma has provided the Central and State Government with four weeks in order to file the replies demanding a satisfactory reply to the Public Interest Litigation.
