Madras HC Refers Questions Of Caste Certificate Verification After Retirement To Larger Bench

Chennai: The Madras High Court has referred the question of whether an employee’s community or caste certificate can be verified after retirement from service to a larger bench.

A Division Bench comprising Chief Justice Manindra Mohan Shrivastava and Justice G. Arul Murugan made the reference on October 28, 2025, while hearing W.P. Nos. 23827 and 23854 of 2025, which involved challenges to the continuation of caste verification proceedings against retired government employees.

The petitioners contended that once an employee retires, any inquiry into their community certificate cannot be initiated or continued. They also argued that certificates issued prior to 1995 should not be subject to scrutiny, relying on prior decisions of coordinate benches holding that post-retirement verification is impermissible.

The State, represented by the Government Pleader, relied on contrary judgments of the High Court, including V. Perumal v. Tamil Nadu State Level Scrutiny Committee-III and C. Arumugam v. The Chairman, State Level Scrutiny Committee-II, which upheld the continuation of such proceedings even after retirement.

The Bench noted that “a clear cleavage of opinion emerges” among coordinate benches of the Court. While some benches have held that verification must continue to its logical end irrespective of retirement, others have held that post-retirement proceedings are invalid if delayed or initiated belatedly by the employer.

Referring to earlier rulings, the Bench observed that conflicting positions have arisen on three major issues:

  1. Whether verification of community or caste certificate can continue after retirement;
  2. Whether such verification is permissible in cases where the certificate or appointment pre-dates 1995; and
  3. Whether an inquiry initiated before retirement can be lawfully continued thereafter.

In view of the conflicting precedents, the Bench referred the following questions to a larger bench for authoritative determination:

  1. Whether verification of the genuineness of a community certificate or caste status of an employee is permissible after retirement from service;
  2. Whether such verification is permissible where the community certificate was issued or the employment granted prior to 1995; and
  3. Whether verification proceedings initiated prior to retirement can be continued after retirement.

The Bench directed the Registrar (Judicial) to place the matter before the Chief Justice for the constitution of an appropriate larger bench to resolve the divergence of views.
